Article 2 â Purpose
These Terms and Conditions of Sale govern the sale of handmade jewellery and accessories through the website lesfantaisiesdevalou.fr.
Placing an order implies full and unconditional acceptance of these Terms and Conditions of Sale.
Article 3 â Products
The products offered for sale are handmade creations.
Due to their unique and handcrafted nature, slight variations in shape, colour or dimensions may occur compared with the photographs displayed on the website.
These variations are part of the authenticity of handmade creations and do not constitute a defect.
Article 4 â Prices
Product prices are displayed in euros (âŹ).
VAT not applicable, Article 293 B of the French General Tax Code.
Any delivery charges are displayed separately before the customer confirms the order.
Les Fantaisies de Valou reserves the right to change its prices at any time. However, the price applicable to an order is the price displayed when the customer confirms the order.
Article 5 â Orders
An order is confirmed once payment has been successfully completed.
An order confirmation email is sent to the email address provided by the customer.
Article 6 â Payment
Payment is made online and securely at the time the order is placed.
The payment methods accepted are those displayed on the website at the time of purchase.
Article 7 â Delivery
Orders are shipped to the address provided by the customer when placing the order.
The available delivery methods, prices and estimated delivery times are indicated on the website and/or during checkout.
Les Fantaisies de Valou undertakes to deliver the products within the timeframe communicated to the customer.
Where no specific delivery time has been stated, delivery will take place without undue delay and no later than 30 days after the conclusion of the contract.
In the event of a delay, loss or damage to a parcel during transit, the customer is invited to contact Les Fantaisies de Valou at:
Les Fantaisies de Valou will assist the customer and seek an appropriate solution in accordance with applicable regulations.
Article 8 â Right of withdrawal
In accordance with Article L.221-18 of the French Consumer Code, the customer has 14 days from receipt of the order to exercise their right of withdrawal without having to provide any reason.
The direct cost of returning the products is borne by the customer, except where a product is defective, damaged upon delivery or does not conform to the order.
The refund will be made no later than 14 days from the date on which Les Fantaisies de Valou is informed of the customer's decision to withdraw.
However, Les Fantaisies de Valou may delay the refund until the returned products have been received or until the customer provides proof that they have been sent back, whichever occurs first.
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply in particular to products made according to the customer's specifications or clearly personalised, or to products supplied sealed for health protection or hygiene reasons which have been unsealed after delivery.

Article 9 â Statutory guarantees
Products sold by Les Fantaisies de Valou benefit from the legal guarantee of conformity provided for in Articles L.217-1 to L.217-32 of the French Consumer Code and the legal guarantee against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code.
The consumer has a period of two years from delivery of the product to exercise the legal guarantee of conformity in the event of a lack of conformity.
Subject to the conditions provided by law, the legal guarantee of conformity entitles the consumer to have the product repaired or replaced free of charge within a maximum period of 30 days following the consumer's request.
Where repair or replacement is impossible, refused, takes place outside the legal time limit or causes major inconvenience to the consumer, the consumer may, under the conditions provided by law, request a reduction in the price or termination of the contract with a refund.
Where a product is repaired under the legal guarantee of conformity, the original guarantee period is extended by six months.
The consumer also benefits from the legal guarantee against hidden defects for a period of two years from discovery of the defect.
This guarantee may allow the consumer either to keep the product and obtain a reduction in the price or to return the product and obtain a refund of the price paid.
Article 10 â Personal data
Personal data collected through the Les Fantaisies de Valou website is processed only to the extent necessary for the management of orders, payments, delivery, customer service and compliance with applicable legal and accounting obligations.
Processing necessary to fulfil an order is primarily based on the performance of the contract concluded with the customer.
Certain information may also be retained in order to comply with legal obligations.
Personal data may only be disclosed to service providers necessary for the operation of the store and fulfilment of orders, including payment providers, delivery providers, hosting providers and technical service providers used by the store.
Personal data is retained only for as long as necessary for the purposes for which it was collected and, where necessary, for the periods required by applicable law.
